This is the Privacy Policy and Terms of Use of JCK Ltd (hereinafter: ‘JCK’). JCK is committed to respecting your data privacy. It explains how JCK deals with all personal data obtained by JCK as a customer, a supplier, an employer and/or obtained via all our websites: www.jckltd.com, www.ims.jckltd.com (hereinafter: ‘the Websites’) and personal data that it obtains via offline requests for information or contact.
We understand that you are aware of and care about your personal privacy interests, and we take that seriously. This Privacy Policy and Terms of Use describes JCK’s policies and practices regarding its collection and use of your personal data and sets forth your privacy rights.
We recognize that information privacy is an ongoing responsibility, so we will, from time to time, update this Privacy Policy and Terms of Use as we undertake new personal data practices or adopt new privacy ways of working with impact to our Data Privacy Policy.
JCK will only use your personal information when the law allows us to.
We do not knowingly attempt to solicit, receive, or process information from children, other than required for long or short stay assignment and mobility related support of our employees.
As is true of most websites, the JCK websites collect certain information automatically and store it in log files. The information may include internet protocol (IP) addresses, the region or general location where your computer or device is accessing the internet, browser type, operating system and other information about the use of the Websites, including a history of the pages you view. We use this information to help us design our site to better suit our users’ needs. We may also use your IP address to help diagnose problems with our server and to administer our website, analyse trends, track visitor movements, and gather broad demographic information that assists us in identifying visitor preferences. The Websites also use cookies and web beacons. These do not track users when they cross to third-party websites and do not provide targeted advertising to them, and therefore do not respond to Do Not Track (DNT) signals.
JCK has a legitimate interest in understanding how members employees, potential employees, customers and potential customers use the Websites. This assists us with providing more relevant information on our products and services, with communicating value to our sponsors and corporate members, and providing appropriate staffing to meet member employee and customer needs.
JCK collects personal information about its existing (potential) customers, business relations, employment candidates and employees, social media followers, website visitors, physical visitors on our local sites. Regarding our website visitors, this information is mostly limited to the types of information that can be found on a business card: first name; last name; job title; employer name; work address; work email; and work phone number. We use this information to provide the required information to other JCK businesses and the right customer contacts, as well as other parties related to our business.
We will only use your personal information for the purposes for which JCK collected it unless it is reasonably considered to be needed for use due to another reason and that reason is compatible with the original purpose. If JCK need to use your personal information for an unrelated purpose, JCK will only do so if legally permitted and with appropriate notice.
JCK does not and will never sell any personal information to anyone and only share it with third parties who are facilitating the delivery of JCK services.
JCK has its headquarters in the UK. Information we collect from you will be processed mainly within the European Union, but this may also take place in countries outside of the European Union where we have local subsidiaries (Canada, USA, and Singapore).
The United States has not sought nor received a finding of ‘adequacy’ from the European Union under Article 45 of the General Data Protection Regulations (GDPR). We rely on derogations for specific situations as set forth in Article 49 of the GDPR. JCK collects and transfers to non-members of the European Union personal data only: with your consent; to perform a contract with you; to comply with a legal obligation; or to fulfil a compelling legitimate interest of JCK in a manner that does not outweigh your rights and freedoms. We endeavour to apply suitable safeguards to protect the privacy and security of your personal data and use it only in a way that is consistent with your relationship with JCK, and the practices described in this Privacy Policy and Terms of Use. JCK also enters into data processing agreements and model clauses with its vendors whenever feasible and appropriate.
JCK will only transfer your personal information where we are satisfied that it will be subject to an appropriate level of protection and in accordance with any safeguards that may be legally required.
In order to provide you with a better service, your personal data may be made available to other branches of JCK, including those in countries outside of the European Economic Area (‘EEA’). These branches will use your data solely for the purposes for which it has been provided, for example for the performance of an agreement that has been concluded with you or for providing the information that you have requested. Also, where appropriate in order to facilitate this cross-border data exchange in a GDPR accountable manner.
As a data subject you are entitled to execute your rights according to the relevant privacy law, for instance the GDPR. JCK needs to receive such formal request to do so by e-mail or in writing accompanied with a copy of your ID. You will receive a written response from JCK within 30 days.
You are entitled to peruse the personal information that JCK holds in relation to you. If the information is incorrect, you may request that JCK corrects it. Such requests for perusal or correction of your data can be addressed to our Regional Office, accompanied by a copy of a valid form of identification. The relevant address can be found below.
You can object free of charge to the use of your personal data, as far as this objection does not infringe JCK’s legal obligations and is reasonably proportionate. Your objection to the use of your personal data can be sent by email or in writing to JCK at the address below. If you object to the use of your data for direct marketing purposes, JCK shall immediately cease to use your data for these purposes.
You have the right to receive your personal data provided to JCK by you, in a structured commonly used and machine-readable format. You also have the right to transmit this data to another controller of your choice if you have given us your consent to process it.
YIn case, for instance when you want to withdraw your employment application, you are entitled to ask us to remove your files from our databases within 30 days. JCK will act accordingly as long as it is not conflicting with actual laws that force us to store certain data for a longer time.
JCK does not apply automated individual decision-making or profiling.
To help protect the privacy of data and the personally identifiable information that you transmit using the Websites, JCK always maintains a security level that is adequate, in accordance with the latest technical developments, to prevent unauthorised access to, adaptation, disclosure or loss of personal data. We maintain physical, technical, and administrative safeguards. We update and test our security technology on an ongoing basis. We restrict access to your personal data to those employees who need to know that information to provide benefits or services to you. In addition, we train our employees about the importance of confidentiality and maintaining the privacy and security of your information. We commit to taking appropriate disciplinary measures to enforce our employees’ privacy responsibilities.
The security of your personal data is also based on keeping the login details of your account (username and password) confidential. Never share your login details with anyone else and always take care when using them.
Your personal data is stored by JCK on its servers and on the servers of the cloud-based database management services JCK engages. These third parties do not use or have access to your personal information for any purpose other than cloud storage and retrieval. JCK will not engage third parties to mail information to you.
JCK retains data for the duration of employment of its employees and the customers’ or others business relationships with JCK and for a period thereafter to allow you to recover employment information or accounts if you decide to renew, to analyse the data for our own operations, and for historical and archiving purposes associated with our history as a business partner. JCK will not retain your data longer than is necessary for the purposes for which it was processed, unless the data must be retained longer in order to comply with legal obligations (such as the fiscal obligation to store data for seven years). The length of time for which data is retained depends on the nature of the data and the purposes for which it was processed. The retention period can thus differ for each purpose and for each country.
This Privacy Policy and Terms of Use does not apply to third-party websites that are associated with the Websites by means of links. JCK does not accept any responsibility or liability regarding how these third parties deal with your personal data. JCK therefore recommends that you always familiarise yourself with the privacy policy on the websites concerned.
